The TAKE IT DOWN Act

As of March 16, 2025, the TAKE IT DOWN Act has passed the Senate but awaits
approval in the House of Representatives before it can be signed into law. The bill aims
to criminalize the distribution of non-consensual intimate imagery, including AI-
generated content, and mandates that online platforms remove such material within 48
hours of notification from victims.

The TAKE IT DOWN Act is a bipartisan legislative proposal aimed at criminalizing the
distribution of non-consensual intimate imagery (NCII), including content generated
through artificial intelligence, commonly referred to as “deepfakes”.  The act mandates
that online platforms remove such content within 48 hours of notification from victims,
imposing penalties on those who fail to comply (Cruz & Klobuchar, 2025).

Legislative Progress

In February 2025, the Senate unanimously passed the TAKE IT DOWN Act, reflecting
strong bipartisan support. The bill was introduced by Senators Ted Cruz (R-TX) and
Amy Klobuchar (D-MN). A companion bill has been reintroduced in the House by
Representatives María Elvira Salazar (R-FL) and Madeleine Dean (D-PA) (Salazar,
2025).

Recent Developments

On March 3, 2025, First Lady Melania Trump made a rare public appearance on Capitol
Hill to advocate for the TAKE IT DOWN Act. During a roundtable discussion with
lawmakers, she emphasized the urgency of protecting teenagers, particularly girls, from
the detrimental effects of NCII and deepfake pornography. Her support is anticipated to
expedite the bill’s progression through the House (The White House, 2025).
Implications and Concerns

While the act aims to protect victims of NCII, some civil liberties organizations have
raised concerns about potential threats to free expression and due process. The
Electronic Frontier Foundation, for instance, cautions that the bill’s broad takedown
provisions could lead to the removal of lawful content, including satire, journalism, and
political speech. They advocate for more precise definitions and safeguards to prevent
misuse (McKinney, 2025).

The passage of TAKE IT DOWN would mark a critical step in protecting vulnerable
individuals from digital exploitation and ensuring swift accountability for those who
